EPA Backs State Takeover of Coal Combustion Residuals (CCR)

If final approval is granted, the Indiana Department of Environmental Management will oversee disposal of this toxic waste. It is advertised to be the biggest CCR program in the country, with federal approval expected as early as February or March. It is estimated that there will be 100 CCR units throughout Indiana.


The EPA and Governor Braun argue that a state run program will offer greater control, transparency, and accountability as to how coal ash is managed.


Last year Braun issued an executive order banning new state environmental regulations that are more stringent than federal versions unless explicitly required by law or deemed necessary by the governor's office. This "no more stringent than laws" policy may result in looser restrictions, which Governor Braun denies. Any further federal environmental roll backs could cause less oversight and damaging challenges.
