Indiana Recount Commission Votes Against Subpoenas for Senate District 23 Voters

Indiana state law notes that in order to vote in a party's primary, the voter is required to have voted for a majority of that party's candidates in the last general election.

Requests for recounts from the May primary election were submitted based on this law. The most contentious request comes from Senate District 23, where the Trump backed candidate lost by only three votes. Her petition to the Indiana Recount Commission requested that 11 voters be subpoenaed to explain their vote under oath. She contends that based on social media posts, these voters appear to be Democrats or Independents and should not have been allowed to vote in the Republican primary.

The Commission voted 2-1 not to subpoena voters after ballots have been cast.

The issue of closed primaries in Indiana is expected to be a hot topic during the 2027 Indiana General Assembly. This would require voters to identify with a party in order to vote in the primary elections.
